Article 3: Applicability

1. These general terms and conditions apply to every offer of United Trade and to every agreement between United Trade and a consumer.

2. The terms are shown on the website and at the bottom of the invoice. The consumer signs the invoice for receipt and agreement. On request, United Trade will send the text free of charge.

3. If specific product or service terms apply in addition to these terms, the consumer can always rely on the provision that is most favourable to them in case of conflicting terms.

Article 4: The offer

1. If an offer has a limited period of validity or is made subject to conditions, this is stated explicitly in the offer.

2. The offer contains a clear description of the products and/or services offered. If United Trade uses images, they are a truthful representation of the products and/or services offered. Obvious mistakes or obvious errors in the offer do not bind United Trade.

3. The prices in the offer include VAT.

Article 5: The agreement

1. The agreement is concluded at the moment the consumer accepts the offer and meets the conditions set in it.

2. United Trade may, within the limits of the law, find out whether the consumer is able to meet their payment obligations. If United Trade has good grounds on that basis not to enter into the agreement, United Trade is entitled to refuse an order with reasons or to attach special conditions to its performance.

Article 6: Returns and voucher

1. United Trade does not sell at a distance. Every purchase is a targeted purchase in which the consumer chooses in the showroom. The right of withdrawal that applies to distance sales therefore does not apply.

2. United Trade does not refund money. If United Trade takes a product back, the consumer receives a voucher.

3. If the packaging of the product has been opened, the product cannot be returned. This also applies within 2 weeks of the purchase.

4. The statutory rights of the consumer remain in force.

Article 7: Conformity

1. United Trade guarantees that the products are complete and new.

2. United Trade warrants that the products comply with the agreement, with the reasonable requirements of soundness and usability, and with the legal provisions existing on the date of the agreement. New vehicles may have minor imperfections, such as a loose sticker, a scratch or a missing screw.

3. A warranty from United Trade, the manufacturer or the importer does not affect the statutory rights and claims that the consumer can assert against United Trade on the basis of the agreement.

Article 8: 5-year service warranty

1. United Trade gives a 5-year service warranty. This is a warranty on service and parts. It is not a product warranty on the whole vehicle.

2. If the warranty is invoked, United Trade decides after inspection whether the warranty applies.

3. If there is damage to the frame and the vehicle has not been maintained or inspected, United Trade only provides service and no warranty. With maintenance or inspection we could have seen earlier that the frame was not sound.

4. Damage caused by insufficient maintenance or incorrect use is not covered by the service warranty.

5. This article does not affect the statutory rights of the consumer.

Article 9: Maintenance and use

1. At the time of purchase, United Trade explains how the vehicle must be used and maintained. This concerns, for example, changing the oil, tyre pressure and wear of parts.

2. This explanation is shown on the invoice. The consumer signs the invoice for receipt and agreement. These general terms and conditions are also shown at the bottom of the invoice.

3. The consumer is responsible for the maintenance and correct use of the vehicle in accordance with this explanation.

4. This article does not affect the statutory rights of the consumer.

Article 10: Safe use

1. Safety comes first at United Trade.

2. Children always ride under supervision and with a helmet and protective clothing.

3. Our vehicles are intended for use on private land, unless they have a registration plate.

Article 11: Delivery and performance

1. United Trade observes the greatest possible care when performing the agreement.

2. The consumer collects the vehicle in person at the United Trade showroom. United Trade helps with loading. Vehicles are not shipped. Parts can be shipped.

3. The risk of damage to or loss of the product lies with United Trade until the moment of delivery to the consumer, unless expressly agreed otherwise.

Article 12: Payment

1. The consumer pays the full amount in one go or in two instalments. The vehicle is only handed over once the full amount has been paid.

2. The consumer has a duty to report inaccuracies in the payment details provided or stated to United Trade without delay.

3. In case of non-payment by the consumer, United Trade has, subject to statutory restrictions, the right to charge the reasonable costs that were communicated to the consumer in advance.

Article 13: Complaints procedure

1. United Trade has a sufficiently publicised complaints procedure and handles the complaint in accordance with this procedure.

2. Complaints about the performance of the agreement must be submitted to United Trade within a reasonable time, fully and clearly described, after the consumer has discovered the defects.

3. Complaints submitted to United Trade are answered within 14 days of the date of receipt. If a complaint foreseeably requires a longer processing time, United Trade replies within 14 days with an acknowledgement of receipt and an indication of when the consumer can expect a more detailed answer.

Article 14: Intellectual property

All copyright, all (trade) names and trademarks and all other intellectual property rights in any material or content (as part of) the website rest with United Trade or its licensors. The consumer may only use this material if this has been expressly permitted. The consumer may, where necessary, make a copy of an order or of contact details, as stated on this website.

Article 15: Liability

1. United Trade is not liable for damage, damage to third parties or injury arising from the use of the products purchased, to the extent the law allows.

2. If United Trade should be liable, this liability is limited to what is provided for in these terms and the statutory provisions.

3. United Trade is not liable for damage of any kind arising because United Trade relied on incorrect and/or incomplete information provided by or on behalf of the consumer.

4. United Trade is not liable for indirect damage, including consequential damage, loss of profit, non-material damage, material damage, missed savings and damage due to business or other interruption. In the case of a consumer purchase, this limitation does not go further than is permitted under article 7:24(2) of the Dutch Civil Code (BW).

5. The limitations of liability in this article do not apply if the damage is due to intent or gross negligence on the part of United Trade.

6. United Trade accepts liability for damage resulting from defects in delivered goods for which United Trade is liable.
